You are entitled to a break. Take it up with your district manager or the owner of the store. It is illegal to be denied breaks. I struggle with this with my own team as well, I had to fight my owner for breaks for my staff, threatening a lawsuit if they didn’t oblige. Finally we got 10-15 min breaks which is still not enough legally, but it’s better than nothing.

Depends on the state unfortunately (USA.) Some states don't legally mandate breaks at all.

Allpurplesarah

😳 wow. That’s nuts.

nokomn

Yup. Florida only mandates 30 min breaks for minors. Beyond that it's up to the store owner.

You are indeed a snowflake. Yes, you're entitled to a break but you're in the food service industry - a place where breaks regularly don't happen because business comes first. It sucks, but it is just a reality of the job you signed up for. (I can hear the /r/antiwork crowd staring daggers at me for saying that - no, it shouldn't be that way, but, it is. That's just a fact of the industry) That said, if you don't like it, find another job. Start applying tomorrow and you'll have a new job within the next two weeks. Everyone is hiring. It's crazy. There are definitely slower places to work where you'll have more downtime and a less toxic work environment. Don't even give notice, just quit if you hate it that much. And just because I'm a dick, I'm gonna say it - if you *need* a giant sub to get through the shift, you've got a problem. You're a fat fuck and that's like 1700 calories minimum for one meal. No one needs that, fast metabolism my ass. But yeah - 8 hours without a snack or a break isn't a big deal, you're just a weiner. Sounds like your store sucks though and QSR jobs are a dime a dozen, so go apply somewhere else and have a less shit time at work.

>We don’t do clocked out breaks at my store. You do get to eat though. You can’t make a sub and eat in the back while you stock or fill grill bottles? That’s what we do. We are also at a mall and if someone needs 5 min or 10 min to run to the food court for something different, I allow that too. I also make sure there a change over hour btw 2-4 where the night crew comes in and the day crew sets them up before they go. It’s not your manager. They probably don’t have a lot of applicants- or they do but they no show for interviews (happened to me this weekend) and typically owners make their manager adhere to a strict hourly allotment. Meaning they want you to staff according to sales. When we first opened it took about a year to see that while our other stores are busier towards the weekends, one of our busiest lunch days happen on Mondays. I had to beg to staff up and prove my reasons with hard numbers. JM wants you to run at 20% labor but owners like 15% so I still have to keep it under 15. I bet your manager is frustrated too Im 6 foot 4 220, I dont consider that a fat fuck.

What time does your shop close?

xFirexRose

My store varies depending on if we’re in or out of season but without season it’s 5,000 days

xFirexRose

And we’re typically begging our workers to go on break cuz labor is high

Nope. Not OK. Give notice and find a new job. So many places need workers that you’ll find something better. (My son actually ended up at JM after quitting a situation like you described at a different place. His JM is a lot better.)

Try reporting GM. That’s not fair and sounds like a toxic work environment. I’d recommend transferring or finding somewhere else to work.

If you work the hours required for a break take your fuckin break. They ain't gonna call the police. Don't even talk to the manager report them to the state. Fuck abuse at the work place they are all greedy mother fuckers taking advantage of people just joining the workforce. Not your fault you don't know your worker rights yet. But I suggest you go on your states department of labor website and learn your rights
