Defenses for speeding.
1. Has the speed gun been properly and recently calibrated as per manufacturer recommendations? There should be records of this. If you bring it up in court and they don't show the proof you *should* get off.
2. Was there a heavy vehicle in close proximity to you at the time? If there was then they could be the culprit and not you as even target radar can be interrupted by a larger object in the immediate vicinity.
3. Has the Garda been trained / kept up with training on either the use of a radar gun or sight spotting speeding? There should be records of this. See point 1.
4. Go to court and ask them to prove it. If the Garda who pegged you with the ticket isn't there to defend it and doesn't have the proof above you *should* get off.
Is there any information to suggest that a garda car would have a built in speed detection system? This car was a 152 so even at that the newer technology might only be in the new hyundis id imagine no?
Even if it is, which it probably is, you should still at least try the above.
If you go into court and ask them to prove it then they *should* have to prove it.
Unless, of course, you were speeding I. Which case you're wasting my time 😉
Were you speeding?
Wasn’t pulled over, but sent the penalty points in the post for doing 90 in an 80 zone. I rang and asked for the location of the camera and was given the GPS coordinates. As I knew there were road works on that particular road, I then rang the council and asked them to confirm the speed limit that applied on that day, and was told 100kmph, which was the usual speed limit. So went back to the gardaí, forwarding on the email from the council and was told they were dropped. Always worth asking the questions.
Lies… you had me until ‘I rang the council’ and number one they answered and two you got information from them.
I didn’t say they picked up instantly - as far as I remember it took about four calls to get someone and then after being on hold for a long time, but I was determined. 😂
unwarranted searches make my blood boil. I bet they made the ticket up to cover up for their own failure to find anything on you.
Possibly yeah. I just feel like theres no real evidence to indicate the speed i was travelling at. Therefore how can they actually prove i was speeding
This was only a recent incident so i haven’t received a fine yet. Probably will in the next week or so. They didnt even mention how the points would be applied. Just told me id be getting another 3 points and an €80 fine. Then said i suggest you pay it
And were you known to the guards?
Not at all. No criminal record. Or even suspicion around my name
Next time tell them your drivers licence says it’s ok to speed. See here guard where it says ‘tear along the dotted lines’.
